Endorsement

[1] This endorsement deals with costs arising from a motion heard by me November 1, 2013 and endorsement released November 5, 2013.

[2] The Respondent, mother, seeks full recovery costs in the amount of $11,826.81 and that $4,139.38 be enforced through the Family Responsibility Office. The Applicant, father, asks that no order for costs should be made.

[3] The mother relies on Rule 18 (she made an offer dated October 3, 2013), and Rule 24 (general costs Rule).

[4] In comparing the positions and the offers, there is no question that the Respondent was successful and her offer should entitle her to full indemnity.

[5] Given the expenses and support order, the Applicant will not be able to pay the costs that I now fix at $11,000 but the costs shall be secured against his interest in the matrimonial home and there shall be an order preventing the Applicant from depleting his assets as disclosed in the June 27, 2013 Financial Statement, including United States I.R.A. and Retirement Account.
