[1] Whereas counsel for Troy Saikaley had asked for more money to be released from seized funds to cover their client’s legal fees at the conclusion of the forfeiture hearing on November 8, 2013; and whereas when I rendered my decision on the Crown’s forfeiture application today, I omitted, by inadvertence, to deal with that request.
[2] I therefore make this Order to deal with the request of counsel and refuse the request to provide additional funds from seized assets. I have previously released $80,000 for legal fees to counsel, and considering the lack of cooperation from Troy Saikaley in this matter, and the cost of his prosecution, I am not willing to release any more money.
[3] This decision was made at the time of the request and it was meant to be part of my decision today.
