[1] On motion of the respondent, Dwaine Gaudette; on reading the affidavit of the respondent sworn January 14, 2013, the affidavit of the child, Caitlynn Marie Sylvia Gaudette, born November 9, 1992; the applicant, Penny Ann Gaudette, having died on December 10, 2013; this court orders that the order of Justice McCartney dated April 3, 2007, is vacated and the Divorce Judgment of Justice Stach dated September 12, 1997, is varied by deleting paragraph 5 thereof and substituting the following therefore:
- Commencing on the 15th day of February 2013 and continuing until varied by the court, the respondent Dwaine Gaudette, shall pay directly to the child Caitlynn Marie Sylvia Gaudette, born November 9, 1992, child support of $774.00 per month, payable in two equal instalments each month of $387.00 on the 15th and last day of the month.
5a The Director of the Family Responsibility Office shall not enforce this order and no Support Deduction Order shall issue.
