ENDORSEMENT
[1] In an endorsement dated August 6, 2013, I ordered inter alia.
“7) The parties shall exchange names for a counselor for Rohan within seven days and failing agreement I will receive written submissions no later than August 22, 2013, and appoint a counselor.”
[2] By letter dated August 22, 2013, I received a submission from Mr. Freeze on behalf of Rohan’s mother which included letters from him to Mr. Desai (who acts for Rohan’s father) dated May 9, July 11 & August 20, 2013. As well it included letters from Mr. Desai to Mr. Freeze dated July 3, and August 2, 2013. The CV’s of certain counselors was also included.
[3] Apparently, no agreement was reached regarding the appointment of the counselor.
[4] I did not receive a written submission from the father.
[5] I have reviewed the CV’s of the counselors, as well as their availability as is set out in the letters.
[6] I am satisfied that any one of:
Lynda Dicken;
Lesley Swartz; and/or
Barbara Anderson
is qualified to act as Rohan’s counselor.
[7] I order that father advise the mother within ten days from today’s date as to which counselor he selects from these three names. In the event that the father does not so notify the mother, then the mother shall select a counselor from this list and advise the father forthwith of that selection.
[8] The mother and the father shall cooperate with the selected counselor in arranging Rohan’s appointments and in meeting with the counselor, if the counselor requests such meetings.
[9] I understand that the mother has a benefit plan which pays part of the cost of counseling to a maximum amount.
[10] During the period when part of the costs of the counselor are covered by the mother’s benefit plan, the father shall pay the portion of the costs not covered by the plan.
[11] If the cost of the counseling is not covered by the mother’s benefit plan, or once the benefits have maxed out, on an interim without prejudice basis the parties shall equally bear the cost of the counseling session until such benefits become available. At that time, the father shall once again pay the portion of the costs not covered by the mother’s benefit plan.
