[1] The Plaintiff has noted that the Defendant, Bell Mobility, is in default for failure to file their statement of defence in time and has brought this motion for judgment.
[2] My review of the Statement of Claim indicates that the Plaintiff is seeking “general damages and/or loss of income damages and/or loss of competitive advantage damages in the amount of $15,000”.
[3] There is insufficient evidence substantiating the damages requested.
[4] Accordingly, the motion is denied with leave to the Plaintiff to secure a date for an assessment of damages.
[5] The Plaintiff shall forthwith serve a copy of this endorsement by regular mail on the Defendant Bell Mobility c/o Bell Canada Law Department, 5025 Creekbank Road, 5th floor, Mississauga, ON L4W 0B6.
