1The Plaintiff has noted that the Defendant, Bell Mobility, is in default for failure to file their statement of defence in time and has brought this motion for judgment.
2My review of the Statement of Claim indicates that the Plaintiff is seeking “general damages and/or loss of income damages and/or loss of competitive advantage damages in the amount of $15,000”.
3There is insufficient evidence substantiating the damages requested.
4Accordingly, the motion is denied with leave to the Plaintiff to secure a date for an assessment of damages.
5The Plaintiff shall forthwith serve a copy of this endorsement by regular mail on the Defendant Bell Mobility c/o Bell Canada Law Department, 5025 Creekbank Road, 5th floor, Mississauga, ON L4W 0B6.
