costs ENDORSEMENT

[1] I have reviewed the costs submissions of the parties. The respondents do not take issue with the amount of hours spent or the rates sought by the applicants’ counsel with respect to all of the work done with the exception of the preparation for the motion. In my view, the four hours claimed for preparation is not unreasonable.

[2] I therefore award the applicants the costs of the motion in the amount of $6,510.09 inclusive, plus the costs of preparing costs submissions in the amount of $250.00 plus HST.

[3] The respondents claim that payment of costs within 30 days would cause financial hardship. In my view, the respondents’ actions have placed them in this difficult position but I am prepared to allow them some leeway in this regard. Costs are to be paid within 90 days.
