ENDORSEMENT
[1] The order of Taliano, J. made 9 May 2013 at paragraph 3 directed a motion to be heard in order to determine the payor’s income for 2012. The Notice of Assessment indicates that income to have been $50,542.
[2] The parties argue that a higher or lower figure would be more appropriate for both 2012 and 2013. In fact no one can say with any degree of certainty what the correct amount for 2013 will be. Ongoing child support must, therefore, be calculated using the 2012 figure.
[3] Both parties raised issues concerning adjustments and or payments allegedly made in the past. Such issues cannot be resolved on the basis of conflicting affidavit evidence. If the parties wish such issues to be determined they should be requesting a summary trial.
[4] One issue can be resolved. That is, whether Steven Earl Goodwin is still a full-time student. The applicant has obtained and filed written confirmation of his status. Support, therefore must continue to be paid for Steven.
[5] For the above reasons the Defendant’s obligation to pay child support for Steven is adjusted to $467.00 per month effective 1 March 2013, based upon his 2012 income of $50,542. The Family Responsibility Office is directed to adjust accordingly. The respondent is ordered and directed to advise the applicant of any change in his income during 2013 and his total income for 2013 forthwith after 21 December 2013.
