ENDORSEMENT

[1] Counsel for the Trustee, Capmor and FTA, appear today for Orders to be signed pursuant to the Minutes of Settlement in this matter. I have signed two Orders which bring an end to this proceeding given the settlement on consent.

[2] For greater certainty and, as acknowledged by all parties, it is noted that the Capmor investors retain all the rights and claims they may have as against Capmor in respect of their investments with Capmor and the only effect of the Orders signed today and the Minutes of Settlement in respect of the investors is that no further proceeding may be brought by them, or on their behalf, against the Trustee or FTA or Capmor as to its authority to settle the within proceeding.

[3] Counsel for Capmor shall forthwith send by registered mail to each of the investors a copy of the Orders, together with the affidavit sworn by the principal of Capmor and a copy of this Endorsement.
