COSTS ENDORSEMENT
RE: Endorsement of Snowie J. dated June 22, 2011
[1] This motion was for “intervener” status by Family & Children’s Services for Guelph & Wellington County (known hereafter as: the Agency).
[2] This court found that the Agency had no bona fide interest in the custody/access decision of this court. The Agency was unhappy with the decision of this court and wish to appeal the sole custody of the child awarded to the mother on May 3, 2011. Such an appeal was the decision and the right of the father as unsuccessful litigant not the Agency as an “intervener”. No such Appeal was brought by the father and the time for such an appeal had expired in any event.
[3] The Agency was found by this court to have lost its objectivity and its professionalism and was biased against the mother in this case. Father supported the Agency’s position for “intervener” status for the Agency. Mother opposed the Agency’s position. The mother was 100% successful and as such she shall have her costs.
[4] Mother is seeking costs and disbursements of $6,313.63. Mother is asking the court to impute a fee of $200.00/hour for her time spent preparing and attending court. These are not her real costs but rather fees sought similar to those fees of a junior lawyer. While I agree that mother is a very capable, competent and organized litigant I must be realistic about her costs. The reality is that she is not a junior lawyer. She previously had been employed at $10.25/hour teaching gymnastics and as such I find that I am somewhat limited to this modest amount per hour. As such the Agency shall pay to the mother her costs fixed at 27.8 hours times $10.25 = $284.95 plus disbursements of $133.63 for a total of $418.58 forthwith.
