RE: Endorsement of Snowie J. dated May 3, 2011
[1] No cost submissions were received from the father, R.J.S..
[2] The applicant mother was substantially successful on this lengthy and complex motion. Ms. J.A.B. represented herself in a professional and helpful manner to this court. She was exceedingly organized. Mr. R.J.S. had the benefit of excellent experienced counsel.
[3] I find that the applicant mother should be compensated for her time at her former wage of $10.25/hour. It was necessary for Ms. J.A.B. to spend many hours preparing for this motion – upon which she was successful.
[4] The heinous child abuse allegations of Mr. R.J.S. which proved to be “unfounded” caused mother to be forced out of her former job where she had been working with children at $10.25/hour.
[5] As such the applicant mother shall have costs fixed at a modest $2,497.59, for time spent in preparation and at the motion of $1,304.32 (127.25 hours) plus disbursements of $1,193.27 to be paid by the respondent father forthwith.
