[1] A telephone conference occurred at the request of counsel on January 4, 2013, at 15:30 p.m. Discussions included the dates for motions, cross-motions and the service of materials thereby resulting in the case conference endorsement below:
(1) Counsel for the defendant is to advise the plaintiffs and the Administrator by January 8, 2013, as to his availability to argue the motion and cross-motion on January 18, 2013. Presuming counsel’s availability for January 18th, the motion and the cross-motion will proceed on that date commencing at 10:00 a.m.
(2) In the event that Mr. Burdet is unavailable on January 18, 2013, the motion and the cross-motion will thereupon proceed on Wednesday, January 23, 2013, at 10:00 a.m.
(3) The defendant’s cross-motion is to be served upon the plaintiffs and the Administrator no later than Wednesday, January 9, 2013.
(4) Factums for the motion and cross-motion are to be served by each party herein no later than Monday, January 14, 2013.
(5) Argument of the motion and cross-motion are to be completed within one day.
