[1] The accused applies for a review of the order of the Justice of the Peace which denied him bail.
[2] A new surety has become available and thus a change in circumstances is alleged.
[3] The new surety is the aunt of the accused, Ms Bilton. She is clearly well-meaning, intelligent and an upstanding citizen. However, she was unaware of the extent of the criminal record of the accused and also unaware of the allegations against him. I found that she attempted to make excuses for him when these facts were put to her.
[4] The allegations here involve extreme violence. The plan, in my view does not address the secondary ground. I believe he would be likely to re-offend if released and Ms Bilton would not be able to control him.
[5] The violence involved engages the tertiary grounds which I also rely on.
[6] For these reasons, the application is dismissed.
