1The accused applies for a review of the order of the Justice of the Peace which denied him bail.
2A new surety has become available and thus a change in circumstances is alleged.
3The new surety is the aunt of the accused, Ms Bilton. She is clearly well-meaning, intelligent and an upstanding citizen. However, she was unaware of the extent of the criminal record of the accused and also unaware of the allegations against him. I found that she attempted to make excuses for him when these facts were put to her.
4The allegations here involve extreme violence. The plan, in my view does not address the secondary ground. I believe he would be likely to re-offend if released and Ms Bilton would not be able to control him.
5The violence involved engages the tertiary grounds which I also rely on.
6For these reasons, the application is dismissed.
