REASONS ON COSTS

[1] Following the trial of this action, and the release of my reasons for judgment both parties have made written costs submissions, as contemplated by the judgment.

[2] Each claims to have enjoyed more success than the other at trial. Each claims costs. In my view the applicant was more successful globally on her position on the property issues than was the respondent, particularly since I rejected a great deal of the respondent’s evidence on the property issues. On the other hand, the respondent was more successful in his position on retroactive child and spousal support than was the applicant.

[3] On the issue of settlement offers, neither party “beat” his or her offers. On the whole, I view overall success as divided, and conclude this is not a case for costs. Accordingly, no order as to costs.
