Nature of the appeal
[1] This is an appeal to set aside the final award of arbitration made by Mr. Gerald Sadvari on October 28, 2009. The appellant also, by way of application, asks that this court make a fresh order for custody, child support and spousal support, based on the evidence at the arbitration hearing.

[2] The award under appeal provided as follows:
(a) Appellant to pay to respondent a lump sum for retroactive spousal and child support in the amount of $100,000 for the period from the date of their separation to December 31, 2008.
(b) Appellant to pay respondent retroactive spousal support in the amount of $21,000 (taxable/deductible) to cover the shortfall from January 1, 2009 to the end of October 2009.
(c) Appellant to pay respondent $10,000 a month commencing November 1, 2009 until and including
