[ 1 ] The respondent and applicant both appeared unrepresented wanting to resolve the amount of arrears owed by the respondent for child and spousal support.
[ 2 ] The court record accurately reflects the parties’ agreement of what the respondent’s income for support purposes was from the date of Justice E. Loukidelis’s Order of March 1, 2006 to date.
[ 3 ] The printout from the Family Responsibility Office, also by agreement, reflects what the respondent has paid the applicant since the order “Schedule A.”
[ 4 ] After applying the appropriate calculations to the respondent’s income, I am satisfied that he has made an overpayment of $22,256.86 “Schedule B.”
[ 5 ] However as of March 1, 2006, the respondent was in arrears of support amounting to $13,037.96.
[ 6 ] Further the respondent was responsible for his percentage share of childcare expenses totalling $7,426 and an outstanding costs order of $1,000.
[ 7 ] The respondent has unacceptably delayed bringing this application. I am therefore satisfied that any credit he may be entitled to for paying more during the period than the guidelines mandate be reduced to $0.
[ 8 ] Order to go varying the amount of arrears owed for child and spousal support as of December 31, 2012 to $0.
[ 9 ] As the respondent’s current income is nil, ongoing child and spousal support is varied to $1 per month until further order of the court.
