ENDORSEMENT

[ 1 ] The wife moved to vary the terms of a separation agreement that have to do with child support [2012 ONSC 255]. She seeks costs.

[ 2 ] The parties each had a degree of success. The husband should have made disclosure earlier, but the wife acted unreasonably in deliberately breaching the separation agreement’s requirement that she deposit money into the child’s RESP.

[ 3 ] There will be no order as to costs.
