[ 1 ] The applicant was the successful party on the motion. I find that there was no unreasonable litigation conduct by either party in relation to the motion. In my view, the circumstances do not warrant substantial indemnity costs.

[ 2 ] Accordingly, costs are awarded to the applicant fixed in the amount of $6,800.00 all inclusive, payable within 30 days.
