Reasons
[ 1 ] Each step in a proceeding attracts costs. The expected appeal can consider the propriety of these costs. The Court of Appeal does not need to be troubled with fixing them.
[ 2 ] By written submissions the moving party Respondents seek $2,894.78 at a partial indemnity rate. Preparation was also required for the cross-motion which was subsumed by my decision on the Respondent’s motion.
[ 3 ] It should not have cost so much but I am at a loss why this aspect of the appeal litigation has become so contentious. It has, and hours are spent.
[ 4 ] I fix costs payable to the moving party Respondents at $2,500 all in.
