Reasons
1Each step in a proceeding attracts costs. The expected appeal can consider the propriety of these costs. The Court of Appeal does not need to be troubled with fixing them.
2By written submissions the moving party Respondents seek $2,894.78 at a partial indemnity rate. Preparation was also required for the cross-motion which was subsumed by my decision on the Respondent’s motion.
3It should not have cost so much but I am at a loss why this aspect of the appeal litigation has become so contentious. It has, and hours are spent.
4I fix costs payable to the moving party Respondents at $2,500 all in.
