AMENDED ENDORSEMENT
This is an amendment to the Endorsement released November 21, 2012. The two amendments occur in paragraph [1].
[ 1 ] In view of the position of the Crown as expressed in the fax of November 7, 2012, and the Ontario Court of Appeal decision in R. v. Rocha , 2012 ONCA 707 , the defence application to exclude all of the evidence obtained from the execution of the search warrant at the property located at 18901 Glen Road is granted.
[ 2 ] More fulsome reasons will be provided if required by counsel.
[ 3 ] Counsel may make further submissions on the effect of this ruling on the charges and the result of a trial, if any.
