AMENDED ENDORSEMENT
This is an amendment to the Endorsement released November 21, 2012. The two amendments occur in paragraph [1].
1In view of the position of the Crown as expressed in the fax of November 7, 2012, and the Ontario Court of Appeal decision in R. v. Rocha , 2012 ONCA 707 , the defence application to exclude all of the evidence obtained from the execution of the search warrant at the property located at 18901 Glen Road is granted.
2More fulsome reasons will be provided if required by counsel.
3Counsel may make further submissions on the effect of this ruling on the charges and the result of a trial, if any.
