ENDORSEMENT with respect to costs

[ 1 ] The Respondent, Ms. Simard-Thomas was substantially successful on this motion. Consequently, she is entitled to her costs pursuant to Rule 24(1) of the Family Law Rules, O. Reg. 114/99. She seeks her costs on a partial indemnity basis in the amount of $4,000. I have examined Ms. Simard-Thomas’ counsel’s bill of costs and find it reasonable. The Applicant, Mr. Thomas agrees with this. There will, therefore, be an order for Mr. Thomas to pay Ms. Simard-Thomas’ costs fixed at $4,000, payable forthwith.

ADDENDUM TO MY REASONS ON MOTION

[ 2 ] Both parties agree that there was a further amount of $1,511 to be reimbursed to Ms. Simard-Thomas for monies received by Mr. Thomas from his insurance plan that were amounts of medical and dental expenses belonging to Ms. Simard-Thomas. My decision then should be amended to correct this omission. It is therefore ordered that the total amount owing by Mr. Thomas to Ms. Simard-Thomas is $10,215.77 ($8,704.77 + $1,511) .
