COST ENDORSEMENT

[ 1 ] On June 22, 2012, I released my endorsement in this matter, striking the plaintiff’s statement of claim on the grounds that it did not disclose a reasonable cause of action,

[ 2 ] With respect to the issue of legal costs, I allowed both parties to make submissions within 21 days.

[ 3 ] The defendant seeks costs on a partial indemnity scale in the amount of $5,134.54 all inclusive. The defendant submits it was completely successful on its motion and is entitled to costs pursuant to R. 57 of the Rules of Practice.

[ 4 ] The plaintiff represented himself in this litigation. He sought damages in the amount of 75 million dollars.

[ 5 ] The plaintiff, in response to the costs issue, focused on the merits of his claim and the damages he has suffered.

[ 6 ] I agree with the defendant that it was completely successful on the motion and he is entitled to his costs. I find his bill of costs reasonable and order that the plaintiff pay the costs of the defendant fixed at the all inclusive amount of $5,134.54.
