COSTS ENDORSEMENT
[ 1 ] Mr. Michenko brought this motion for spousal support and it was dismissed. Ms. Vanzella brought a motion for child support and was successful. Under section 24(1) of the Family Law Rules , the successful party is entitled to their costs.
[ 2 ] In dealing with costs the reasonable expectations of the unsuccessful litigant must be considered.
[ 3 ] This matter included Mr. Michenko’s motion; Ms. Vanzella’s cross-motion; a factum; review of affidavits; two court attendances; preparation and attendance at Rule 20 questioning; written submissions and argument at a long motion.
[ 4 ] I reviewed the time spent by the counsel by Ms. Vanzella. It appears reasonable.
[ 5 ] On a partial indemnity basis I order costs of $6,000.00 payable by Mr. Michenko to Ms. Vanzella.
