Ruling on Costs of the Assessment Hearing
PARAYESKI J.
[ 1 ] After having carefully considered the written submissions of Messrs. Smye and Kirby, I am of the view that there should be no order as to the costs of the assessment hearing before me. Success was indeed divided. On the one hand, the plaintiff did have to participate in the hearing in order to quantify the costs to which she was entitled. On the other, the costs sought for her were substantially reduced for the reasons previously provided. In such circumstances, it is appropriate that each party bear its own costs. So ordered.
