Addendum to Reasons For Judgment Released May 30 2012
[ 1 ] Following the release of my Reasons For Judgment May 30, 2012 Counsel for the defence wrote with a copy to the Crown raising the following issues:
a) The replacement of the dynamite lawfully held by the accused but seized and destroyed by the police.
b) The return of items 149 and 150 which were said to be in trust in the same manner as item 148 but which Schedule 1 of the reasons shows as being forfeited.
c) The return of the “home made silencers” said to be flash suppressors.
d) The return of all auxiliary items such as slings, telescopic sights etc.
e) The return of all other items seized (other than money which is supposed to be the subject of a separate action) such as books, binoculars, computers etc.
[ 2 ] The Crown replies:
a) That with respect to items 1, 2 ,3, above the court is “functus” and can make no further order.
b) That with respect to 4 and 5 above, the Crown agrees that all auxiliary items such as slings, telescopic sights etc. shall be ordered returned, together with books, computers and binoculars.
[ 3 ] I do not accept that I am entirely functus. The court retains the ability to correct accidental slips and omissions.
a) While I do not accept the notations I made on Ex 1 of the forfeiture hearing as being the last word, a comparison of my notations on Ex 1 with Schedule 1 to my reasons shows that while on Ex 1 I made the notation “exempt JW” against items 148, 149 and 150, on Schedule 1 of my reasons I made the notation “D” [items held in trust: see ¶7 of the Reasons] against item 148 but I made the notation “I” [items to be forfeited] against items 149 and 150. This was an accidental slip. The correct notation should have been “D”. An amended schedule 1 is attached hereto.
b) I am not prepared to make an order for the return of the dynamite or its equivalent at this stage in the proceedings. That may be the subject of other proceedings.
c) I am not prepared to make an order for the return of the silencers/flash protectors other than those such as item 257 already specifically ordered to be returned. I am not satisfied that their true nature was properly established on the trial or hearing.
d) It was always agreed that that which was not subject to forfeiture (other than the money which is said to be the subject matter of other proceedings) was to be returned and an order will issue accordingly.
e) It was always agreed that auxiliary items such as slings, telescopic sights, flashlights, lasers, holsters etc. did not constitute part of the firearm being forfeited and were to be returned. See ¶ 66 of the Reasons. An order will issue accordingly.
