[ 1 ] This cost endorsement follows my endorsements of June 22 and 26, 2012, granting relief to the applicant.

[ 2 ] I have reviewed the written submissions of the parties as to costs, including information concerning settlement positions taken.

[ 3 ] I have considered the factors set out in Rule 57 that should guide the exercise of my discretion and particularly the expectations of the parties if unsuccessful.

[ 4 ] The applicant is entitled to her costs to be paid out of the estate, including taxes and disbursement, fixed at $13,656.93 payable forthwith.
