SUPPLEMENTARY REASONS FOR JUDGMENT

KERSHMAN j.

[ 1 ] Further to my Reasons for Judgment dated June 8, 2012, the Court has received correspondence from Mr. Augustine dated June 11, 2012 seeking to make additional submissions on the issue of costs as they relate to Offers to Settle exchanged between the parties, as well as additional submissions as to who should pay the costs.

[ 2 ] The Court has also received correspondence from Mr. Cutler dated June 12, 2012 requesting that no further submissions be allowed.

[ 3 ] At the end of the four‑day hearing, at the request of the Court, counsel provided Costs Outlines. No information about Offers to Settle was provided. Counsel should have been aware that the Court was going to make a decision which included costs. This was in fact done.

[ 4 ] As such, the Court will not receive any further submissions as to the issue of costs.

[ 5 ] Order accordingly.
