SUPPLEMENTARY

ENDORSEMENT

[ 1 ] Subsequent to the release of my initial Endorsement, Citation: 7080 / dated December 8, 2011, I did not address the plaintiff’s request in paragraph 1(A)(c) of the Statement of Claim that requested an order for possession of Cavalon Inc.’s, assets, property and undertaking pursuant to the General Security Agreement executed by the corporation.

[ 2 ] This request by the plaintiff is granted and there will be an order for possession of Cavalon Inc.’s assets, property and undertaking.

[ 3 ] The award of pre-judgment interest referenced in paragraph 28 of my Endorsement is to run from October 6, 2009, the date claimed in the Statement of Claim, at the rate prescribed by the Courts of Justice Act . Further, the plaintiff is entitled to post-judgment interest in accordance with the provisions of the Courts of Justice Act .
