Costs Endorsement

[1] In my endorsement, I invited the parties to file written submissions with respect to costs. Those submissions have now been filed.

[2] Both parties claim costs.

[3] Clearly, success was divided. In my view, none of the offers to settle served by the applicant affect the matter.

[4] Three separate offers to settle were served on the same day, and while the applicant succeeded in matching one of them, she clearly did not match the other two.

[5] In the result, there will be no order as to costs.
