1In my endorsement, I invited the parties to file written submissions with respect to costs. Those submissions have now been filed.
2Both parties claim costs.
3Clearly, success was divided. In my view, none of the offers to settle served by the applicant affect the matter.
4Three separate offers to settle were served on the same day, and while the applicant succeeded in matching one of them, she clearly did not match the other two.
5In the result, there will be no order as to costs.
