ENDORSEMENT AT SANCTIONS HEARING

[ 1 ] On February 17, 2012, this Court has found the Respondent in contempt of court.

[ 2 ] For oral reasons given, this Court orders that Mr. Luckman shall be imprisoned from today, April 18, 2012 until Monday April 23, 2012.

[ 3 ] In addition, Mr. Luckman shall pay costs of the contempt motion fixed at $5,500.00 inclusive of disbursements and HST, which shall be paid within 30 days of today.

[ 4 ] The costs previously ordered by Justice Robertson on March 25, 2011 of $2,000.00 are still outstanding and shall also be paid within 30 days of today.

[ 5 ] In the event that the two sets of costs totaling $7,500.00 is not paid in full within 30 days of today by certified cheque or money order, all of Mr. Luckman’s pleadings shall automatically be struck without notice to him. All that is required is an Affidavit from the Applicant stating that the full amount of these costs has not been paid. If the pleadings are struck, the Application will proceed on an uncontested basis.

[ 6 ] This Court orders that Mr. Luckman shall provide the balance of the outstanding disclosure within the next 50 days, failing which, a motion can be brought before Kershman J. on notice to strike his pleadings.

[ 7 ] Pursuant to a previous court order, Mr. Luckman has deposited his Canadian Passport and Permanent Resident Card with the Court. These shall be released to him on April 25, 2012. A representative from the court office will contact Mr. Luckman at 613-297-2488 on April 24, 2012 to arrange for return of these documents.

[ 8 ] In the event that Mr. Luckman’s pleadings are not struck, the matter shall proceed to a Settlement Conference on June 19, 2012 at 3:00 p.m. before me.

[ 9 ] Order accordingly.
