ENDORSEMENT
1Subsequent to the release of my Reasons for Decision dated January 20, 2012, Wayne Dyce advised my office that he did not receive a copy of the Interim Endorsement that I sent to the parties requesting further written submissions with respect to the decision of O’Connell J. dated September 23, 2011.
2I afforded Wayne Dyce the opportunity to make written submissions if he so desired. I have not heard from Wayne Dyce, notwithstanding the fact that my assistant has attempted to contact him to enquire as to whether submissions are forthcoming.
3The timeline that I set for submissions from Wayne Dyce has now long expired and no further submissions will be entertained from any of the parties.
4This being the case, it is now appropriate that the parties make their costs submissions. Ms. Lyons-Batstone is to deliver her costs submissions within 21 days of the date of this letter. Wayne and James Dyce have 14 days thereafter to respond and Ms. Lyons-Batstone, 7 days thereafter to reply.
