ENDORSEMENT

[ 1 ] Subsequent to the release of my Reasons for Decision dated January 20, 2012, Wayne Dyce advised my office that he did not receive a copy of the Interim Endorsement that I sent to the parties requesting further written submissions with respect to the decision of O’Connell J. dated September 23, 2011.

[ 2 ] I afforded Wayne Dyce the opportunity to make written submissions if he so desired. I have not heard from Wayne Dyce, notwithstanding the fact that my assistant has attempted to contact him to enquire as to whether submissions are forthcoming.

[ 3 ] The timeline that I set for submissions from Wayne Dyce has now long expired and no further submissions will be entertained from any of the parties.

[ 4 ] This being the case, it is now appropriate that the parties make their costs submissions. Ms. Lyons-Batstone is to deliver her costs submissions within 21 days of the date of this letter. Wayne and James Dyce have 14 days thereafter to respond and Ms. Lyons-Batstone, 7 days thereafter to reply.
