Costs ENDORSEMENT

[ 1 ] After releasing my decision in this matter I invited costs submissions from Counsel.

[ 2 ] On consent, the Plaintiff and the Defendants in this action have agreed that the costs of the motion shall be assessed by the trial judge in the cause.

[ 3 ] The non-parties, SkyLink Aviation Inc. and Walter Arbib, have waived any right to costs and accordingly, no costs shall be payable to them.
