Supplementary ENDORSEMENT ON Motion to amend the statement of claim
[ 1 ] Counsel had discussed the appropriate procedure to follow were I to allow the amendments, given that the amendments are being made during the cross-examination of Mr. Genest.
[ 2 ] After consultation with counsel, I order as follows:
a. The plaintiffs will complete their cross-examination of Mr. Genest.
b. The defendant will file its amended statement of defence in reply to the plaintiffs’ amendment of its statement of claim within seven days of today’s date.
c. The defendant will provide the plaintiffs with any further productions relating to the amendments at least three business days prior to Mr. Genest being recalled to complete his testimony.
d. At a future date to be determined, the defendant may examine Mr Genest in chief on new matters raised in the amendments. The defendant’s counsel may meet with Mr. Genest for this purpose.
e. After completion of Mr. Genest’s examination in chief, the plaintiffs may conduct further cross-examinations which will be limited to new matters raised in his additional examination in chief.
f. Thereafter, the defendant may re-examine Mr. Genest in respect of any of his cross-examinations.
g. At the completion of the examination of witnesses scheduled to testify on behalf of defendant and before it closes its case, the defendant may call further witnesses regarding matters raised in the amendments. If required, it may request an adjournment for this purpose.
