Decision on Motion
[ 1 ] This matter began as an ex parte motion to enforce the order of Pierce, J. of October 18, 2011, whereby Woosley (the father) was to have interim interim custody of the children, Jaden Ryan Medicine, born August 6, 2003, Mia Elise Medicine, born May 8, 2007 and Joaquin Jarvis Medicine, born March 27, 2005.
[ 2 ] Ms. Medicine (the mother) was to have interim interim access on alternating weekends – as well as certain telephone access. The matter came before Fregeau, J. on February 8, 2012 and he ordered that the matter be adjourned and that the motion material be served on the mother. The mother did not formally respond, but attended at this hearing by telephone conference from Fort Frances.
[ 3 ] The evidence indicates that the children were to be returned to the father after the mother’s weekend access on Sunday February 5, 2012. They were not returned and the father brings this motion requesting the police to apprehend the children and return them to the father. The mother indicated that she does not intend to voluntarily return the children to the husband as per the said order of Justice Pierce.
[ 4 ] The motion is allowed. Any police force in Ontario having jurisdiction in the area where the children Jaden Ryan Medicine, born August 6, 2003, Mia Elise Medicine, born May 8, 2007 and Joaquin Jarvis Medicine, born March 27, 2005 are found are hereby order to apprehend the children and return them to their father Jeffrey James Woosley who has interim interim custody of them as per the order of Pierce, J. of October 18, 2011.
[ 5 ] There will be no costs awarded regarding this motion.
