The applicants, owners of the 'DAHU HOTPOT' trademarks, brought an undefended application for trademark infringement, passing off, and depreciation of goodwill after being excluded from their restaurant in Richmond Hill.
The court found that the respondent 1000237903 Ontario Inc. infringed the trademarks by operating the restaurant with identical marks.
The court granted declaratory and permanent injunctive relief against 1000237903 Ontario Inc., ordering delivery-up of infringing materials and transfer of domain and social media accounts.
The application against the other respondents, including the director of 1000237903 Ontario Inc., was dismissed due to insufficient evidence.
