Partial costs awarded to Caring Society in public interest litigation despite mixed results on motions.
Following motions by the Attorney General of Canada and the First Nations Child and Family Caring Society, the Court determined costs.
Although there were mixed results, the Court exercised its discretion to award partial costs to the Caring Society at the lower end of Column III of Tariff B due to its public interest role and more successful defense against the stay motion.
No costs were awarded to the other respondents.
