Eli McDonald appealed his conviction for breach of probation and the imposed sentence.
The trial judge had found McDonald guilty of contacting the victim of harassment after consent for contact was revoked, rejecting his "pocket dial" defence.
McDonald raised multiple grounds of appeal, including reversal of the burden of proof, misapprehension of evidence, and an unfit sentence.
The appeal court dismissed all grounds, finding no error in the trial judge's W.(D.) analysis, no material misapprehension of evidence, and that the sentence was not demonstrably unfit, especially given a previous, longer sentence for the same offence.
