Sentencing for distributing an intimate image without consent contrary to s. 162.1(1) of the Criminal Code.
The offender recorded sexual activity, sent images and video to the complainant, her friend, and her family, posted the video to a pornography website, and posted a related image in a false sex-services advertisement.
The court held that denunciation and deterrence were paramount, but concluded that a 22-month conditional sentence with full-term house arrest, community service, and strict no-contact conditions remained proportionate in light of the offender's guilty plea, remorse, mental health history, strong rehabilitative prospects, compliance on bail, and severe collateral immigration consequences.
A two-year probation order, DNA order, and $200 victim surcharge were also imposed.
