The applicant brought a motion to change an earlier custody order and a subsequent support agreement to require the respondent to contribute to a child's post-secondary education expenses as special and extraordinary expenses under s. 7 of the Child Support Guidelines.
The adult child was attending university full-time and had a documented budget for tuition and living expenses.
The respondent argued estrangement from the child and offered to contribute a reduced amount directly to the child.
The court held that parental estrangement was not determinative of the support obligation and rejected the argument that it should reduce the respondent’s contribution.
The court also found the respondent had understated his income and imputed income of $60,000, ordering payment of arrears and ongoing proportional contributions toward the university expenses.
