The Manitoba Court of Appeal allowed his appeal and overturned the conviction.
The Crown appealed to the Supreme Court of Canada.
The Supreme Court allowed the appeal in a brief oral judgment, finding no error in the trial judge's decision and concluding there was evidence to reasonably support the conviction.
The conviction was restored.
