Justice O’Brien directs as follows:
[1] The Applicant has written to the court requesting an in-person ex-parte motion. That is not the appropriate procedure to address the issues he has raised. His requests can be addressed by written directions from the court.
[2] The Applicant states he seeks to appeal the order of Corbett J. dismissing his application pursuant to r. 2.1 of the Rules of Civil Procedure. An appeal of Corbett J.’s order does not lie to this court. It may be brought to the Court of Appeal. The Applicant would need to bring a motion to the Court of Appeal seeking leave and an extension of time to appeal the order of Corbett J. The question of whether a court file was created in the Divisional Court does not impact a motion for an extension of time and leave to appeal to the Court of Appeal. In addition, to the extent the Applicant is concerned about having a copy of Corbett J.’s order for the purpose of his motion in the Court of Appeal, that order is attached.
[3] If, as suggested in his e-mail, the Applicant found he was unable to file materials in the Divisional Court when he attempted to do so, he should be aware that, pursuant to Corbett J.’s order, he may not do so without the permission of an administrative judge of the Divisional Court or their delegate. I am an administrative judge of the Divisional Court. To the extent the Applicant’s e-mail is requesting permission to pursue an appeal of the order of Corbett J. in this court, permission is denied because he is seeking to start his appeal in the wrong court.
