[1] My apologies to counsel on this application. I have just been advised that counsel did submit an agreement on costs on October 31, 2025. Counsel have agreed that in the event the applicant (Royal LePage) prevails in the judicial review application and the matter is remitted back to the HRTO for a hearing then there shall be no costs to either party on the judicial review application itself, but Royal LePage shall pay Ms. Barry-Sproule costs thrown away in the amount of $8,000.00, inclusive of HST and disbursements. Such costs shall be paid within 45 days of the decision. Order accordingly.
