CASE MANAGEMENT ENDORSEMENT
[1] On September 16, 2025, the court issued directions lifting the stay of eviction in this matter because of the tenant’s failure to pay rent and rental arrears, which the court had previously directed him to do as a condition of the stay pending appeal.
[2] At the time the landlords sought to lift the stay, they also sought to have the appeal quashed. The appeal was not quashed at that time, but the tenant was given 14 days to advise the court whether he seeks to pursue his appeal. It has now been over three weeks since those directions were issued and the tenant has not advised that he intends to pursue his appeal. In addition, the tenant’s materials on the appeal were due to be filed on September 15, 2025 and have not been filed.
[3] The tenant has failed to comply with the court’s directions, has delayed in pursuing his appeal, and it appears he does not intend to pursue his appeal. In these circumstances, the appeal is dismissed.
