[1] We are not satisfied that the Decision of May 24, 2024 and the Reconsideration Decision of August 23, 2024 should be quashed. We are not persuaded by the appellant’s claim that there was procedural unfairness. The appellant was given notice of the hearing before the Licence Appeal Tribunal (“LAT”). He did not avail himself of the opportunities to request a hearing in person or request accommodation. He did not make his limitations known to the LAT. He was difficult to reach. He did not claim procedural unfairness in his Reconsideration request.
[2] Based on the submissions of counsel for CAA Insurance and our review of the record, we are satisfied that the Decision and Reconsideration Decision are not a bar to the appellant’s claims for attendant care benefits or a special award relating to the timing of the payment for non-earner benefits. Although the Decision states that the appellant was not entitled to the benefits claimed, non-earner benefits plus interest, among other benefits, were in fact paid shortly before the hearing.
[3] The appeal and application for judicial review are dismissed. In all the circumstances we do not consider this an appropriate case to award costs.
