[1] The motion for leave to appeal the decision of Leef, J. dated February 24, 2025, is dismissed and the motion for leave to extend the time for filing a motion for leave to appeal the decisions of Hughes J. dated May 17, 2023, and November 24, 2023 is also dismissed.
[2] With respect to the motion to extend, the Moving Party failed to establish that he formed an intention to appeal within the 15-day period, failed provide a satisfactory explanation for the delay and failed to demonstrate that the proposed appeal has merit. Further, granting the motion for an extension could jeopardize the trial proceeding during the May trial sittings in Oshawa. Thus, the justice of the case does not warrant the granting of leave to extend.
[3] The Responding Party is entitled to her costs of the motion for leave to appeal the order of Leef J. fixed in the amount of $5,000.00 and to her costs of the motion to extend fixed in the amount of $4,000.00.
