ENDORSEMENT
[1] The motion for leave to appeal the decision of Lavine J. dated May 22, 2024 is granted on the issue of whether Her Honour erred in ordering, as a term of the dismissal of a motion for a Mareva injunction, that the Moving Parties pay into court to the credit of this action the net proceeds of sale of certain defined lands.
[2] Costs of the motion for leave to appeal are reserved to the panel that hears the appeal and are fixed at $5,000 all-inclusive.
