rEASONS FOR DECISION
D.L. Corbett J. (Orally):
[1] Mr. Kim seeks judicial review of the Human Rights Tribunal decision summarily dismissing his complaints related to his treatment at the respondent CAMH.
[2] In his written material and oral submissions, Mr. Kim submits that his medical records contain mistakes – both factual and grammatical and disclose negligence in his treatment at CAMH. He submits that all of this has created distrust and shows negligence and malpractice. Mr. Kim firmly believes his condition is not as serious as the medical records indicate.
[3] The Tribunal dismissed Mr. Kim’s complaint because it does not raise a serious issue about discrimination on a prohibited ground. Mr. Kim argues there is age discrimination because he is the youngest in his family and is much younger than his treating psychiatrist. There is nothing in the record to link age to the conduct complained of and the HRTO decision to this effect is reasonable.
[4] The HRTO is entitled to deference in controlling its process and we are satisfied the summary dismissal decision was reasonable. In view of our conclusion about the initial HRTO decision, it is not necessary to address the decision below not to undertake reconsideration.
