Endorsement
[1] The parties seek a consent adjournment of the urgent stay motion scheduled by RSJ Newton as set out in his endorsement dated February 23, 2024 (2024 ONSC 1163). The parties put forward proposed terms that have been amended after discussion at a case conference today and remain on consent.
[2] The interim stay motion brought by the applicant (CLFN) is adjourned on terms, as follows:
(1) RSJ Newton’s interim interim stay of February 23, 2024, shall remain in place until the earlier of: (a) the court’s decision on the CLFN motion, if it is brought back on in accordance with paragraph (2) below; (b) the court’s decision on CLFN’s application for judicial review; or (c) the parties’ consent to lift the interim interim stay (in whole or in part) in writing between them.
(2) On two weeks’ notice, any party may request a case conference to seek a new schedule for CLFN’s interim stay motion;
(3) Costs up to and including February 23, 2024 will be in the cause of the application for judicial review.
[3] By March 28, 2024, the parties shall report to the court regarding the proposed schedule for the application for judicial review.
