[1] The motion for leave to apply for judicial review the decisions of Adjudicator Paul Winfield dated February 15, 2023 (the “Jurisdiction Decision”) and March 28, 2023 (the “Substantive Decision”) is granted, with costs of $5,000.00, inclusive, payable in the discretion of the application panel.
[2] The moving party has paid the disputed amount into court at the direction of a single judge of the Divisional Court. The impugned orders are stayed on condition that the funds paid into court shall remain in court pending final decision by the application panel.
[3] The moving party shall serve its Notice of Application and D2 and shall provide a copy of these documents to the court, by email, by May 26, 2023. The parties should confer on an agreed schedule for exchange of application materials and be prepared to provide this schedule to a case management judge of the Divisional Court by June 9, 2023.
