ENDORSEMENT

[1] At the outset of this judicial review the Court raised as a preliminary issue the jurisdiction of both the Internal Complaints Review Committee and the Child and Family Services Review Board and the role each play in proceedings undertaken pursuant to the Child Youth and Family Services Act, 2017, S.O. 2017, c. 14, Sched. 1.

[2] We direct that this preliminary issue be determined prior to a hearing of this application on the merits.

[3] We adjourn this matter to December 22, 2022, at 10:30 at which time submissions will be heard by Zoom.

[4] Each party is to provide a concise Factum to be uploaded into the Caselines no later than 4:30 p.m. on Friday December 16, 1022. Counsel is to provide a copy of this Endorsement to the Child and Family Services Review Board with an invitation to provide a Factum and to make submissions at the hearing scheduled for December 22, 2022.
