[1] Mr. Tallon’s request for an adjournment of the appeal is granted. He has explained the difficulties he has had in obtaining the transcripts of the Board hearing because of difficulties getting Legal Aid Ontario to pay for the transcripts.
[2] Emails from Legal Aid Ontario and a transcription service, only dated this week, indicate that the transcripts have now been ordered, and they should be ready by the end of July. The respondent has not alleged any actual prejudice if the adjournment is granted.
[3] Accordingly, the following timetable is ordered:
Mr. Tallon shall serve his materials including an appeal book, factum and transcript for the appeal by September 9, 2022.
Responding materials shall be served by October 11, 2022.
The parties shall contact the Divisional Court office immediately to obtain a new appeal date.
The Divisional Court office is directed to ensure the parties are informed of the process and timing of uploading materials to Caselines.
If the Landlord and Tenant Board decides to file materials, it shall do so no later than October 28, 2022.
